Poland Suffers Another Court Setback at CJEU, We May Know Why


Today, once again, Evgeni Tanczew, a spokesman for the EU Court of Justice (CJEU), issued an opinion negative for the Polish government.  The statement in which he attacked the Polish disciplinary judiciary is full of manipulations.

According to a portal Wpolityce.pl we should pay closer attention to another person at the Luxembourg Court. It turns out that the person who at assigns cases to Mr. Tanchew is Maciej Szpunar, former deputy foreign minister in the former (2010–2013)government formed by Civic Platform and Polish People's Party (*) and once a close associate of P.M. Donald Tusk. 

Mr. Szpunar also has strong connections with "opposition" judges, which may explain his bias. He is also a good friend of Judge Krystian Markiewicz, president of the highly politicized association "Iustitia". 

Tanchev's opinions almost always follow the line and resolutions of the association mentioned above. In the key cases before the CJEU for Polish reforms of the justice system, Yevgeny Tanchev is almost always appointed to be the advocate general. He is responsible for inconsistent and contradictory opinions to the judgments of the CJEU and treaties, which undermine the constitutional principles in Poland.

(*) Both Civic Platfsoftorm and Polish People's Party are "total opposition" parties to the current government. Civic Platform is suspected of at least two attempts of "soft" coupes ever since they lost elections. Donald Tusk, former President of the European Council, is considered a quiet leader of the "total opposition."
