Polish parliament working on a judicial reform bill as a compromise with EU, question of constitutionality

The draft amendment to the law on the Supreme Court was submitted to the Sejm by PiS deputies on the night from Tuesday to Wednesday. According to the authors, the proposed regulations are intended to meet the key milestone indicated by the European Commission on KPO. According to the draft amendments to the Supreme Court Act, the Supreme Administrative Court will resolve disciplinary and immunity cases of judges.

President Andrzej Duda referred to the amendment to the law on the Supreme Court. He clearly outlined the limits of the concessions he would agree to.

– I will not allow any legal act to be introduced into the Polish legal system, which will undermine the appointments of judges, which will allow anyone to verify the nominations made by the President of the Republic of Poland – stated President Duda.

At the same time, he announced that he would support "solutions that will allow us to exercise our rights as a member state of the European Union." – It is our right to receive money from the frozen EU Aid – emphasized the President.

During the negotiations, there were attempts by the European Commission to limit these presidential prerogatives.
