The European Commission submits a complaint against Poland to the Court of Justice of the European Union in connection with reservations regarding the Constitutional Tribunal and its jurisprudence. The point is that the Tribunal found the provisions of the EU treaties incompatible with the Constitution of the Republic of Poland and questioned the principle of the primacy of EU law over national law.
Neither in the earlier treaties nor in the current ones there are no provisions establishing the supremacy of EU law over the law of the Member States - says prof. Genowefa Grabowska in an interview with the news portal, DoRzeczy.
