According to the Polish constitution, Tusk's government has incorrect composition

 The National Council of the Judiciary issued a statement after the end of Friday's meeting. The National Council of the Judiciary stated that Barbara Nowacka, Katarzyna Kotula and Marzena Okła-Drewnowicz "did not take up the office of minister" due to the way they took the oath.

"The incorrect composition of the Council of Ministers results from the failure to take the oath in accordance with the constitutional content of the oath rota by the Minister of Education Barbara Nowacka and the Minister for Equality Katarzyna Kotula, who instead of the words "taking over the office of minister" uttered the words "taking up the office of ministry" and due to Marzena's Okłę-Drewnowicz statement that she takes over the Office of the Minister for Social Policy in a situation where, by the decision of the President of the Republic of Poland, she was appointed to the position of Minister for Senior Policy," we read in the announcement of the National Council of the Judiciary.

"Each person appointed to the Council of Ministers in the presence of the President of the Republic of Poland was obliged to take an oath in accordance with the wording of Article 151 of the Constitution," says the statement.
