The Sejm has received a request from the prosecutor's office to revoke the immunity of former Prime Minister M. Morawiecki, Katarzyna Karpa-Świderek, spokeswoman for the Speaker of the Sejm, confirmed to the press.
The case concerns the organization of postal elections during the COVID-19 pandemic. The prosecutor's office claims that the former prime minister allegedly exceeded his powers.
According to the prosecutor's office, the assessment of the evidence "provides a basis for assuming a reasonable suspicion that MP Mateusz Morawiecki has committed a crime of exceeding his powers as a public official, Prime Minister of the Council of Ministers and failure to fulfill his obligations in this respect, thereby acting to the detriment of the public interest in the form of respect for the legal order and constitutional voters' rights and led to pointless, ineffective and unjustified spending of public funds in a total amount of not less than PLN 56,450,406 ($13,604,678) to the detriment of the State Treasury.
Former Prime Minister Mateusz Morawiecki (PiS) announced that he would willingly waive his immunity because he acted following the constitution when organizing the "envelope elections."
Jarosław Kaczyński commented on the matter on the X. In it, the leader of Law and Justice (PiS) argues that he considers the allegations against Mateusz Morawiecki absurd. He reminds us that presidential elections are a constitutional requirement.
"The accusations against @MorawieckiM are absurd. Presidential elections are a requirement of the Constitution, which until recently was eagerly invoked by today's rulers. Postal elections during the pandemic were previously carried out in other countries, and the postal voting procedure already existed in Polish law."
Jarosław Kaczyński reminds us that the Civic Platform's activities prevented mail-in elections.
The decision on the election date, in accordance with the Constitution, was made by the Speaker of the Sejm, and its implementation was the responsibility of the entire state administration - central and local government. The Prime Minister implemented this decision with the determination necessary in the conditions of a major epidemic. The sole responsibility for the fact that the elections were ultimately not held lies with the Civic Platform, which openly called for obstruction and failure to fulfill constitutional obligations.
