EU bureaucrats realize that their dispute with Poland has no legal basis, hence the attacks

As reported by the newspaper, Rzeczpospolita, the EU authorities are aware that their accusations against Poland related to the issue of the rule of law are groundless. Therefore, there is no substantive prerequisite for suspending the disbursement of EU funds.

The European Commission has "frozen" the Polish National Reconstruction Plan (KPO) amid concerns over the rule of law. The KPO is a document that allows member states to reach for funds from the EU Reconstruction Fund. As part of this package, Poland will receive a total of EUR 58.1 billion - almost EUR 23.9 billion in the form of subsidies and EUR 34.2 billion in loans. The government has until 2026 to use this money.

The Polish government argues that the actions of the European Commission are illegal. Deputy Minister of Funds and Regional Policy, Waldemar Buda, did not rule out that the government would take "radical" measures against the Commission if it did not approve the Plan or present objective objections.

Prof. Jabłoński referred to the reports of "Rzeczpospolita" on Polish Radio 24. As he emphasized, the EU bureaucrats deliberately led to a legal clinch with Poland.

Government asked President of Poland to extend the state of emergency for 60 days

 The Council of Ministers has decided to ask the president to extend the state of emergency for 60 days, said government spokesman Piotr Müller. The application will be submitted to the president today.

The state of emergency in the border zone with Belarus (part of the Podlaskie and Lubelskie provinces) has been in force since September 2. It covers 183 towns (115 in the Podlaskie Voivodeship and 68 in the Lubelskie Voivodeship). It was introduced for 30 days under the ordinance of President Andrzej Duda, issued at the request of the Council of Ministers.

Every day, hundreds of migrants try to cross the Polish border illegally. The Polish Border Guard takes all measures, as well as the army and the police, to prevent this type of action. It is our duty to secure not only the border of Poland, but also of the European Union. In this case, the border is the same, therefore we are responsible not only for the security of Poles, but also for the security of the entire EU - said Piotr Müller.

We should remember that President Lukashenka's provocations may continue and we can also observe from the information that we receive from our intelligence services and other countries' intelligence services that these actions are organized in nature, - he added.

Crisis on Poland-Belarus border: Belarusian officers fire in the air, point their weapons at Polish soldiers, terrorists among detained

Poland, the European Production Center for Lithium-Ion Batteries

 Poland is the largest in Europe and the fifth in the world supplier of lithium-ion batteries and their components for electric cars.

At the end of 2020, the value of exports of lithium-ion batteries reached approx. EUR 400 million per month, and now they account for as much as 2% of all Polish exports. This is almost a third of European demand for batteries for electric vehicles, says Politico. According to Bloomberg New Energy Finance (BNEF), Poland currently ranks first in Europe and fifth in the world among the countries particularly involved in building the European and global value chain of the battery sector and has a chance to maintain a leading position in this area at least until 2025.

Poland owes the leading position to the LG Energy Solution, whose plant in Kobierzyce near Wrocław is Europe's largest factory of batteries for e-vehicles. The planned expansion may result in the facility having the largest production potential in the world.

Demokraci dążą do uchwalenia trzech głównych ustaw w ciągu jednego tygodnia

 Izba Demokratów dąży do przyjęcia ustawy o infrastrukturze, ustawy o finansowaniu rządu oraz pakietu wydatków prezydenta Joe Bidena w wysokości 3,5 biliona dolarów w ciągu jednego tygodnia, napisała Nancy Pelosi w liście do jej kolegów z partii Demokratycznej.

The need for steel is growing in construction and industry, where it is used, among others, to produce household appliances and in the automotive industry.

Unfortunately, steel, even with higher prices, is not readily available now. On the Polish market, price increases are mainly caused by a shortage of supply. Some industries, such as household appliances, indicate the lack of raw materials as one of the main obstacles to production development.

EU steel production in 2016-2018 was "under weighty import pressure." In 2018, more than 34 million tonnes were imported, with European production falling simultaneously. Market protection measures introduced by the European Commission from mid-2018 resulted in a decline in imports, which did not bring about the expected change because the weakening steel consumption - especially in the automotive industry - and the uncertainty of demand forced steel mills to further reduce production.

During the rapidly awakening demand for steel in China in mid-2020, the steel market in Europe also began to recover. But not fast enough while imports face many obstacles because of protective instruments for steel products which significantly reduce the possibility of supplementing the deficiencies with imports. Anti-dumping duties, in many cases, exceed the level of 25% and are calculated regardless of availability.

The level of rebound in the steel market after the pandemic crisis surprised the market and companies. The dramatic rise in prices is a response to increased demand, shortages, and limited supplies.

Still, it's a good problem to have.

Polish company to acquire 21 licenses on the Norwegian Continental Shelf

 A Polish company,PGNiG Upstream Norway, has just received approval from Norwegian authorities to acquire all assets of INEOS E&P Norge. Once the transaction is completed, the PGNiG Group will acquire a portfolio of promising upstream assets, set to meaningfully contribute to the delivery of its strategic objectives in natural gas production.

The estimated payment upon completion of the transaction will be approx. USD 323 million versus initially agreed USD 615m for the contractual transaction date of January 1st, 2021. The difference is attributable to the reduction of the initially agreed price by income generated by INEOS E&P Norge over the first nine months of the year.

The purchased licences include producing fields: Ormen Lange (14%) Marulk (30%) and Alve (15%). The key asset is Ormen Lange, the second largest gas field on the Norwegian Continental Shelf. As part of the transation, PGNiG Upstream Norway will also acquire an 8.2% interest in the Nyhamna gas processing plant (8.2%), which receives the output of Ormen Lange and Aasta Hansteen, among other fields.

Polish KGHM will sign an important agreement with NuScale Power LLC on nuclear energy

 The management board of KGHM Polska Miedź has agreed to conclude an agreement with NuScale Power LLC - a producer developing reactors in the SMR technology (small modular reactors) and the consulting company PBE Molecule. KGHM assumes that it will launch the first reactor in 2029.

The agreement concerns the development of nuclear technology in the form of repowering of existing coal turbines or the development of new nuclear energy sources in the form of SMR - from 1 to 12 modules with a capacity of 77 MW each.

PKN Orlen plans to purchase the first hydrogen-powered locomotive in Poland

The company explained that the hydrogen locomotive it intends to purchase is a prototype, and its production has just ended - the vehicle was created on the basis of the SM42 shunting locomotive, which after modernization "gained not only an innovative drive but also a modern look."

"The minimalist design of the vehicle's body refers to current trends. Its lifting capacity is approximately 3200 tons, and the daily demand for hydrogen is approximately 170 kg. The locomotive is equipped with two symmetrical refueling points, which will allow for faster filling of the tanks. maneuvering work "- explained PKN Orlen. "Today we have carried out a very thorough analysis of the situation on the border with Belarus. In the last hours of last weekend, a tragic discovery was made, because 3 people who crossed the Polish border, mainly due to hypothermia and exhaustion, have died" - the PM said at a press conference on Monday.

"We try to help and save lives of all people who crossed the border with Poland wherever possible. It can be said that we saved the lives of 8 such people (also last weekend) who were trapped in the floodplains of the Supraśl river" - he added. 

According to Morawiecki, this is an organized action by the Lukashenka regime, designed to destabilize the Polish-Belarusian border "in the most massive way possible." In September alone, there were almost 4,000 attempts to cross the border illegally. 

The prime minister informed that the deceaseds' identities are not known yet, but the government will want to identify them "so that everyone is treated with dignity." 

Morawiecki added that recordings from cameras and drones show that people are transported to the Belarusian border guard posts. There they are instructed and transported to the border with Poland.

Morawiecki stressed that his additional concern is that Belarus introduced a visa-free regime with several countries with immense potential for illegal immigration to keep the pressure on the EU's external border.

Their additional equipment will include automatic driver assistance systems such as the Mobileye Shield+ and the MirrorEye systems. The former allows risks related to the vehicle’s blind spot to be eliminated. Thanks to the cameras placed on both its sides, the driver receive warnings of pedestrians and cyclists located nearby. The MirrorEye is, in turn, a system of cameras that replace the rear- and side-view mirrors. Apart from ensuring optimal visibility regardless of weather conditions, as well as at night, they also reduce the total width of the bus, which is particularly important on narrow streets or with increased road traffic. Moreover, the buses will feature a passenger counting device that will allow the carrier to collect data on passenger flows in buses.

It was in 2015 that Solaris vehicles first made their way to the fleet of the operator Transports Metropolitans de Barcelona (TMB). Poland has another electric car start-up, Vosco Automotive

 Vosco Automotive announced that their electric car, Vosco, will go into limited production this fall. If true, that would make it the first Polish electric car.

What are the treaty provisions that allow to combine the rule of law with the payment of European funds? Where do the treaties state that the arbitrary decisions of a single EU official can decide whether or not a Member State's legal system complies with EU law, since it is the law of sovereign Member State? - She asked. 

Another Polish MEP, Professor Krasnodębski, said that "there are growing doubts as to whether the Commission itself is acting within the law conferred on it by the Member States in the Treaties."

He reminded everyone that article 13 of the Treaty on European Union states that each institution acts within the limits of the powers conferred on it by the Treaties.

Meanwhile, we are dealing with a process in which the Commission, but also the European Parliament, are constantly expanding their competencies contrary to this principle at the expense of the Member States, ignoring their legal and political order - he noticed.

European Parliament passed a non-binding resolution to protect LGBTQ+ people ... in Poland and Hungary

 Why bother in protecting human rights in China, Afghanistan, Middle East, and other countries if you can protect them in Poland. And all of that because LGBTQ activist photographed himself in different parts of it with signs, apparently self-made, that he alleged were posted there declaring LGBT Free zones. 

MEPs on Tuesday voted strongly (387 for, 161 against, and 123 abstentions) in favor of a resolution calling on the European Commission to consider sanctions against Poland and Hungary for breaching European “values” on LGBTQ+ rights as well as “measures against Poland for violating principles of non-discrimination” of LGBTQ+ people.

The European Parliament called “on the Commission to make full use of the tools available to it, to address the clear risk of a serious breach by Poland and Hungary of the values on which the Union is founded,” the text reads.

How does that compare to reality? In the last 12 months (or more) there were several instances where LGBTQ activists attacked and damaged and even destroyed churches and religious monuments. While the perpetrators were identified and in some cases arrested there is not one case that we know of that those responsible, some of them were politicians, were sentenced or even brought to court because judges simply refused to do so. That would be the same judges who complain against Poland violating the "rule of law."

Stefan Wyszyński (1901 – 1981) was a Polish prelate of the Roman Catholic Church. He served as the archbishop of Warsaw and archbishop of Gniezno from 1948 to 1981. He was created a cardinal on 12 January 1953 by Pope Pius XII. He assumed the title of Primate of Poland. To many he was the unquestionable leader of the Polish nation (the uncrowned King of Poland), in opposition to the totalitarian government. He is also credited for the survival of Polish Christianity in the face of its repression and persecution during the reign of the 1945–1989 Communist regime. He himself was imprisoned for three years and is considered by many to be a Polish national hero.

The case for his beatification and canonization opened in 1989 and has many proponents in the Vatican and in his native Poland, where he is well known for his heroic and principled stand against National Socialism and Communism. Pope Francis named him as Venerable on 18 December 2017 upon confirming his heroic virtue. He was scheduled to be beatified in Warsaw on June 7, 2020 but the beatification was delayed because of the COVID-19 pandemic. It was rescheduled and celebrated on September 12, 2021.

Róża Czacka (1876 – 1961) was a founder of the Franciscan Sisters Servants of the Cross who serve the Blind throughout their lives. 

Upon becoming blind at age of 22 she spent a decade traveling throughout Europe hoping to learn about techniques that she could use to help the blind; she adapted Polish phonetics into the Braille alphabet that ended up becoming mandated in all schools for the blind since 1934. 

Czacka entered the Franciscan Third Order in 1917 before founding her own religious congregation in late 1918 based on ideas that she had formulated since at least 1915. Her work received approval from the apostolic nuncio Achille Ratti (the future Pope Pius XI) who lauded her efforts as an exceptional apostolate. In 1950 she retired her role as the Superior General for her order due to her declining health.

The process for her beatification launched in 1988 in her native Poland before it moved to Rome for further investigation. Pope Francis confirmed her heroic virtue and named her as Venerable on 9 October 2017 before later approving a miracle attributed to her in late 2020.

President of Poland will not meet with Merkel. Germany set the date without consulting Poland

Gołas odtworzył ponad 120 ról filmowych, kabaretowych, teatralnych i telewizyjnych. Był także wykonawcą kultowej piosenki "W Polskę idziemy".

The European Commission seeks financial penalties for Poland

 The European Commission said on Tuesday it had asked the EU's top court to impose financial penalties on Poland in a dispute over judicial reform and the activities of a judges' disciplinary chamber.

On July 14, Poland was obliged by the CJEU to "immediately suspend" the application of national provisions relating to the powers of the Disciplinary Chamber of the Supreme Court. The Polish government argues that doing so will break Polish.

"The government has no measures which, without violating the principle of the independence of the judiciary, could suspend the operation of the court chamber and the effects of its decisions."

In reply to the European Commission, it was stated that "Poland will continue reforms of the judiciary, also in the areas of judges' responsibility, the aim of which is to improve the efficiency of this system." 

The dispute already has negative effects on the Polish judiciary. "Old" (those from the communism era) judges feel untouchable and act like it. Several cases of corruption and actual theft by the judges hang in limbo because of it. They enjoy the immunity that can only be lifted by the disciplinary chamber. There is a growing number of court decisions that favor politicians and activists of the political opposition.

The EC plays a very dangerous game which may result in the collapse of the entire Polish judiciary system unless of course, that's their goal.

 The Polish authorities do not expect tension on the eastern border to drop. Polish Army is moving forces to eastern border "testing" its ability to do it quickly

 Officially Polish Army is testing its ability to move a large number of troops across the country in case of emergency but it is hard not to see that in a few days Russia will undergo the largest maneuvers (200,000 troops) near Polish borders in decades.

The head of the Ministry of National Defense provided the information about the exercises on Twitter.

 "The ability of the Polish Armed Forces to move quickly is crucial. The 12th Szczecin Mechanized Division is starting one of the largest exercises in years. Soldiers are moving from the west to the eastern training grounds," he wrote.

The representatives of the 12th Division wrote on Twitter that 4,000 soldiers and almost 1,000 units of military equipment will take part in the exercise. The first phase of the exercise involves moving wheeled transport using public roads.

We need to remind here that a number of eastern regions of Poland, directly neighboring Belarus, are under a State of Emergency. Russian maneuvers, Zapad 2021, will include Belarus and its territory.

Poland declares state of emergency in two provinces over Belarus border row. Also, "Nobody will teach us what democracy and the rule of law are"

 Poland declared a state of emergency in two regions bordering Belarus on Thursday following a surge of illegal migration that Warsaw has blamed on its neighbor.

While European Union accuses Belarusian President Alexander Lukashenko of encouraging hundreds of migrants to cross into Polish territory to put pressure on the bloc over sanctions it has imposed on Minsk Poland accuses him of engaging in human trafficking and charging migrants $10,000 a head for helping them cross into Poland and therefore the EU.

Meanwhile, Poland's Prime Minister wrote on Facebook: 

Nobody will teach us what democracy and the rule of law is because Poland has a very long and noble history of fighting all kinds of totalitarianisms and despots.

"We fought for the rule of law and democracy during the terrible years of communism, but we have a much longer tradition of democratism and we do not want to be taught by anyone from Western Europe what democracy is, what the rule of law is, because we know it best."

The “homemade” flamethrower of the Warsaw Uprising

 “The K pattern flamethrower” was a man-portable backpack flamethrower, secretly produced in occupied Poland during World War II for the partisans. 

Design work on a simple flamethrower suitable for clandestine production in ordinary workshops, of readily available materials, started in 1942 upon the request of the Home Army. Polska może nie otrzymać pieniędzy z UE, chyba że zaakceptuje prymat prawa unijnego

 Komisarz ds. gospodarczych Paolo Gentiloni powiedział w środę, że podważanie przez Polskę prymatu prawa Unii Europejskiej nad prawem krajowym wstrzymuje uruchomienie 57 mld euro unijnych funduszy naprawczych.

Z wyjątkiem Polski. Plan wydatków Polski spełnia wszystkie kryteria. Problemem jest przekonanie, że konstytucja ma pierwszeństwo przed kaprysami unijnych biurokratów, przynajmniej niektórymi z nich.

Gentiloni, przemawiając do Komisji Gospodarczej i Budżetowej Parlamentu Europejskiego, powiedział, że ostatnie posunięcie polskiego rządu, zwrócenie się do trybunału konstytucyjnego o rozstrzygnięcie, czy prawo UE stoi ponad prawem krajowym, było czynnikiem wstrzymującym zgodę Komisji na wypłaty dla Warszawy.

To tyle jeśli chodzi o demokrację Unii Europejskiej i „rządy prawa”.

Poland may not receive recovery money from EU unless it accepts primacy of EU law

European Economic Commissioner Paolo Gentiloni said on Wednesday that Poland's challenge to the primacy of European Union law over national law is holding up the release of 57 billion euros in EU recovery funds. 

Poland, like all other countries of the 27-nation group, is to receive large grants and cheap loans from the EU to rebuild its economy greener and more adapted to the digital age after the economic slump caused by the coronavirus pandemic.

But each country is to get its share of the money only once the European Commission, the EU's executive arm and the guardian of EU laws, approves its national spending plan that has to comply with criteria set out in EU law. Except for Poland. Poland's spending plan meets all the criteria. Its belief that its constitution has primacy over EU bureaucrats' whims, at least some of them, is a problem.

Gentiloni, speaking to the economic and budget committee of the European Parliament, said that the latest move by the Polish government, asking the constitutional tribunal to rule whether or not the EU law does stand above national law, was now an additional factor holding up the Commission's approval for disbursements to Warsaw.

So much for the European Union's democracy and 'the rule of law.'

 Wczoraj po południu Biden przemówił do narodu i nazwał ewakuacje z Afganistanu olbrzymim sukcesem. Oczywiście resztę wieczoru na takich kanałach jak CNN dobrze opłacani "dziennikarze" i publicyści prześcigali się w pochwałach Bidena i krytyce Trumpa. 

Okazuje się, że amerykanskie "elity" są przekonane, że powtarzane kłamstwa zostaną uznane za prawdę i już w przyszłym tygodniu Amerykanie o wszystkim zapomną.

Najbardziej w tym wszystkim jest jednak widoczna arogancja i brak szacunku dla tych którzy tracą życie tylko dla tego, że nasi "liderzy" po prostu nie mają żadnych kompetencji. Wczoraj Biden zrzucił winę nawet na tych którzy zostali zostawieni w Afganistanie jednocześnie powtarzając, że on zawsze jest odpowiedzialny za dobre i złe decyzje. Problem w tym, że już chyba nikt w to nie wierzy. Wczoraj Wall Street Journal opublikował znamienną opinię: 

Amerykańscy prezydenci muszą podejmować trudne decyzje, a my jesteśmy skłonni ich wspierać, gdy robią to w interesie narodowym. Ale wyzywająca, oskarżycielska obrona prezydenta Bidena we wtorek była tak nieuczciwa i tak pozbawiona autorefleksji i odpowiedzialności, że nie była warta poświęceń, jakie Amerykanie ponieśli w tym konflikcie.
